1. Promoter

This promotion is conducted by Liebherr-Australia Pty Ltd (ACN 007 970 452) of 1 Dr Willi Liebherr Drive Para Hills West, 5096 Australia ("Liebherr").

2. Campaign Period

The promotion commences on 17 Aug 2026 at 12:00am AEST and closes on 16 Oct 2026 at 11:59 pm AEST, unless extended, varied, suspended or withdrawn in accordance with these Terms and Conditions ("Campaign Period").

3. Nature of the Offer

Subject to these Terms and Conditions, an Eligible Customer will be eligible to receive a fixed value Fuel Credit in respect of an Eligible Machine where:

• (a) Liebherr issues the initial written quotation for the Eligible Machine to the Eligible Customer during the Campaign Period; and
• (b) the sales contract for the Eligible Machine is executed by both Liebherr and the Eligible Customer during the Campaign Period and remains valid, binding and in force until the Fuel Credit is issued.

Eligibility is determined by the date on which the initial written quotation is issued and the date on which the sales contract is fully executed. The scheduled or actual delivery date of the Eligible Machine does not affect eligibility and may occur after the Campaign Period.

Machines that were first quoted during the six month period immediately preceding the commencement of the Campaign Period are not eligible for the promotion unless otherwise approved by Liebherr in writing.

4. Eligible Machines

The promotion applies only to selected new machines as confirmed by Liebherr in writing at or before the time the relevant purchase agreement is entered into, being:

• Liebherr wheel loaders manufactured by Liebherr-Werk Bischofshofen GmbH in Bischofshofen including L 538, L 546, L 550, L 556, L 566, L 580 and L 586; and
• Liebherr material handlers manufactured by Liebherr-Hydraulikbagger GmbH in Kirchdorf an der Iller including LH 18, LH 22, LH 26, LH 30, LH 40 and LH 50, including both C and M variants but excluding the LH 50 High Rise Industry and LH 50 High Rise Port variants.

(each an "Eligible Machine" and collectively, the “Eligible Machines”)

Used machines, demonstrator machines, rental fleet machines, hire machines, parts, attachments, services, and any other products are excluded unless Liebherr agrees otherwise in writing.

5. Eligible Customers

To be eligible, the customer must:

• be a business registered in Australia;
• purchase an Eligible Machine from Liebherr during the Campaign Period;
• not be in default under the relevant purchase agreement or any other agreement with Liebherr;
• comply with these terms and conditions; and
• complete all relevant scheduled servicing through Liebherr or an authorised Liebherr service provider.

Eligibility for the promotion and any entitlement to a Fuel Credit are personal to the Eligible Customer and apply only to the Eligible Machine identified in the relevant purchase agreement. Neither eligibility nor any Fuel Credit may be assigned, transferred, novated, sold or otherwise dealt with without Liebherr’s prior written consent. Any purported transfer without that consent is ineffective.

6. Calculation of Fuel Credit

The Fuel Credit will be calculated as follows:

Fuel Credit = H x C x P

Where:

• H is the Eligible Machine’s actual operating hours capped at 1,000 hours;
• C is the standardised average fuel consumption rate for each Eligible Machine expressed in litres per operating hour. The standardised average fuel consumption rate for each Eligible Machine will be determined by Liebherr acting reasonably, having regard to relevant information available to Liebherr, including, but not limited to any published fuel efficiency information, manufacturer specifications, and other relevant technical data; and
• P is a fixed fuel price of AUD $2.20 per litre.

("Fuel Credit")

For example, if the Eligible Machine’s standard average consumption is 10 litres per hour and it operates for 1,200 hours, then the total Fuel Credit will be:

1,000 x 10 x AUD $2.20 = AUD $22,000

The Fuel Credit:

• is calculated using standard model assumptions only;
• is not adjusted for actual fuel consumption, fuel price movements, site conditions, operator behaviour, application, load profile, idle time, maintenance condition, or machine utilisation;
• does not represent a warranty, guarantee or representation about actual fuel consumption, productivity, fuel efficiency or operating cost; and
• is capped at the fixed value confirmed by Liebherr for the relevant Eligible Machine.

7. Fuel Price Assumption

The fuel price of AUD $2.20 per litre is a fixed promotional assumption only. It does not represent the actual price paid or payable by the customer for fuel and will not be adjusted if market fuel prices increase or decrease. Liebherr will not be responsible for any difference between the fixed promotional fuel price assumption and the customer’s actual fuel costs.

9. Delivery of Fuel Credit

Subject to compliance with these terms and conditions, the fuel credit will be issued when machine is delivered.

10. Usage of Fuel credit

The Eligible Customer may elect to apply the Fuel Credit entirely to one of the following options:

• Liebherr parts and services credit: an amount equal to 100% of the Fuel Credit; or
• Discount on the Eligible Machine: a direct discount on the purchase price equal to 80% of the total Fuel Credit.

11. Fuel Credit Expiry

Where the Customer elects to receive the Fuel Credit as Liebherr parts and services credit, the credit must be redeemed within twenty four (24) months from the delivery date of the Eligible Machine, after which any unused balance will expire.

12. No Combination with Other Offers

This promotion cannot be used in conjunction with any other discount, rebate, campaign, special offer, fleet pricing arrangement or negotiated commercial incentive unless Liebherr agrees otherwise in writing.

13. Variation, Suspension or Withdrawal

Liebherr reserves the right to amend, suspend, extend or terminate the promotion at any time, provided that any such amendment, suspension, extension or termination will not reduce an eligible customer’s accrued entitlement after the customer has entered into a binding purchase agreement, except to the extent permitted by law or where the customer has not complied with these terms and conditions.

14. Limitation of Liability

To the extent permitted by law, Liebherr’s aggregate liability in connection with this promotion is limited to the provision of the fuel credit to which an Eligible Customer is entitled under these terms and conditions.

15. Governing Law

These Terms and Conditions are governed by the laws of South Australia. The parties submit to the non-exclusive jurisdiction of the courts of South Australia.
