Right of withdrawal for sales contracts
You have the right to withdraw from this sales contract within fourteen days without giving any reason. In the case of a sales contract, the withdrawal period is fourteen days from the day on which you, or a third party nominated by you (other than the carrier), took possession of the goods.
In the case of a sales contract covering several items which you have ordered as part of a single order and which are delivered separately, the withdrawal period begins on the day on which you, or a third party designated by you (other than the carrier), took possession of the last item.
In the case of a contract of sale for the delivery of goods in several instalments or items, the withdrawal period begins on the day on which you, or a third party designated by you (other than the carrier), took possession of the last instalment or the last item.
In the case of a contract of sale for the regular supply of goods over a specified period, the withdrawal period begins on the day on which you, or a third party designated by you (other than the carrier), took possession of the first item.
To exercise your right of withdrawal, you must inform us (Liebherr-Purchasing Services GmbH, Memminger Straße 120, 88400 Biberach, fax number: +49 (0) 7351 41 4978, email address: [email protected]) by means of a clear statement (e.g. a letter sent by post, a fax or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send notification of your exercise of the right of withdrawal before the withdrawal period expires.
Consequences of withdrawal:
If you withdraw from this sales contract, we shall refund to you all payments we have received from you, including delivery costs (with the exception of any additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract of sale. We will make this refund using the same payment method you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund.
We may withhold the refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier
You must return or hand over the goods to us without undue delay and, in any event, no later than fourteen days from the day on which you notify us of your withdrawal from this sales contract. The deadline is met if you dispatch the goods before the expiry of the fourteen-day period. You shall bear the direct costs of returning the goods.
You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that goes beyond what is necessary to ascertain their nature, characteristics and functioning.
